Wine-Searcher API Terms of Use

By using any of the Wine-Searcher APIs, you agree to these Wine-Searcher API Terms of Use (the Terms of Use). If you disagree with any of the terms below, Wine-Searcher does not grant you a license to use the Wine-Searcher API.

Wine-Searcher Ltd. ('Wine-Searcher') reserves the right to update and change, from time to time, these Terms of Use. We will let you know of any changes by emailing the last email address we have for you. You agree that you will monitor your emails and will abide by any future Terms of Use changes.

Licensed Uses and Restrictions.

The Wine-Searcher APIs are owned by Wine-Searcher and are licensed to you on a worldwide, non-exclusive, non-sub-licensable basis. All rights not expressly granted to you are reserved by Wine-Searcher.

Subject to the restrictions set forth in these Terms of Use, YOU MAY use the Wine-Searcher APIs and any updates provided by Wine-Searcher (in its sole discretion). Your license for the Wine-Searcher APIs under these Terms of Use continues until it is terminated by either party. You may terminate the license by discontinuing use of all or any of the Wine-Searcher APIs. Wine-Searcher may terminate the license at any time for any reason.

You understand that Wine-Searcher monitors API usage per application or service utilizing the Wine-Searcher APIs, and may terminate your license if misuse is detected. You understand and agree that programmatic methods intended to subvert Wine-Searcher usage monitoring is considered a violation of these Terms of Use.

If you wish to confirm that your application constitutes an acceptable use of the Wine-Searcher APIs, or wish to inquire about rate limits, contact us.

You understand that all data presented by the Wine-Searcher API is owned by Wine-Searcher.

API Users Agree To:
Place a hyperlinked 'Powered by Wine-Searcher' logo (as below) on each web or application page where the API data is used. Both logos are: 32px (height) X 200px (width)

You Shall Not:

(i) Sell, lease or sub-license the Wine-Searcher API.

(ii) Use a Wine-Searcher API in a manner that exceeds reasonable request volume, or constitutes excessive or abusive usage, as determined by Wine-Searcher in its sole discretion.

(iii) Use a Wine-Searcher API in a product or service that competes directly with products or services offered by Wine-Searcher.

If you wish to use a Wine-Searcher API in any manner or for any purpose inconsistent with these Terms of Use, you may do so only by obtaining Wine-Searcher's prior written authorization. To request such authorization, please contact us.

Disclaimer of Any Warranty.

The Wine-Searcher APIs are experimental and have not been fully tested. Wine-Searcher does not represent or warrant that any of the Wine-Searcher APIs are free of inaccuracies, errors, bugs or interruptions, or are reliable, accurate, complete or otherwise valid.

Wine-Searcher makes no warranty of any kind, and Wine-Searcher expressly disclaims all warranties, whether express, implied, statutory or otherwise, related to or in connection with the APIs and/or data, including, without limitation, the implied warranties of merchantability, fitness for a particular use or non-infringement of third-party rights.

The APIs and data are provided to you on an 'as is' and 'where is' basis. Wine-Searcher does not warrant that the APIs and/or data, as applicable, (1) will satisfy your requirements, (2) will be uninterrupted, (3) are without defect or error, or (4) that operation thereof will provide any particular level of functionality or performance. You are solely responsible for your use of the API and data.

Your use of wine-searcher APIs is at your own discretion and risk, and you will be solely responsible for any damage that results from the use of any Wine-Searcher API, including, but not limited to, any damage to your computer system or loss of data.

Limitation of Liability.

In no event will Wine-Searcher be liable to you or any third party for any indirect, special, incidental, consequential, exemplary or punitive damages arising out of or related to the APIs or data, including, but not limited to, damages for lost data or lost profits, under any theory of liability, including, but not limited to, contract or tort (including negligence) and whether or not Wine-Searcher was or should have been aware of the possibility of such damage and regardless of whether this agreement fails in its essential purpose.

General Terms.

Relationship of the Parties. Notwithstanding any provision hereof, for all purposes of the Terms of Use, you and Wine-Searcher shall be and act independently and not as partner, joint venture, agent, employee or employer of the other. You shall not have any authority to assume or create any obligation for or on behalf of Wine-Searcher, express or implied, and you shall not attempt to bind Wine-Searcher to any contract.
